Terms of Service
Please read the following Terms of Service agreement carefully. By using this Service you agree to be bound by the terms and all terms incorporated herein by reference. It is the responsibility of you, the user or prospective user, to read completely through these terms. If you do not agree to the terms of this Service, please do not use this Service.
Acceptance of Terms
The following Terms of Service (TOS) agreement is a legally binding agreement that governs the relationship between between the users of this Service and Lead Farmers PPC.
Definition of Service
The Service rendered to users by Lead Farmers PPC is Google Ads Management. This includes the creation of a Google Ads campaign, management of the Google Ads campaign, and monitoring of the Google Ads campaign. The Service is delivered through a Google Ads account owned by the user of the Service, or through a Google Ads account created by Lead Farmers PPC with the expressed permission of the user. Lead Farmers PPC is the sole owner of the created campaigns for the purpose of this Service delivered into the user’s Google Ads account. Any changes made to campaigns by Lead Farmers PPC are considered updates to the delivered Service and are covered in this TOS. Continued use of the delivered Service by the user will be seen as an acceptance of said changes.
Limitation of Liability
You explicitly acknowledge, understand, and agree that Lead Farmers PPC shall not be liable for any punitive, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages which may be related to the loss of any profits, goodwill, data, and/or other intangible losses, even though the possibility may exist. Lead Farmers PPC will also not be liable for any of the above damages caused by alterations to the delivered Service made by the user, or unauthorized third party users.
Intellectual Property Ownership
Lead Farmers PPC alone shall own all right, title and interest, including all related intellectual property rights, in and to any content and other property used in delivering the Services. This Agreement is not a sale and does not convey to you any rights of ownership therein.
Third Party Interactions
Beginning on the start date of the Service, Lead Farmers PPC and the user of the Services shall be the only operators allowed access to the Google Ads account that the Service is being delivered to. Third party interactions are prohibited for the entirety of the Servicer to user relationship.
Third Party Interactions
Under no circumstances is a user to export any of the data or goods delivered by Lead Farmers PPC through this Service. The delivered goods through the Service are proprietary to Lead Farmers PPC and are not to be duplicated or transferred.
Billing
The start date of the Service will Serve as the monthly recurring billing date for the Service. Payments are setup on a monthly recurring cycle. Services rendered by Lead Farmers PPC are paid each month in advance of Service delivery. Billing will recur monthly until a cancellation request is submitted and completed, or until a termination due to delinquency is processed.
Non Payment and Termination
Lead Farmers PPC reserves the right to terminate the Services if your account becomes delinquent. This Agreement commences on the Start Date and will continue as stated in the Billing section. Any breach of your payment or other material obligations will be deemed a material breach of this Agreement. Upon any such breach, without limiting its ability to pursue other remedies, Lead Farmers PPC may terminate this Agreement.
Cancellations
Cancellation requests must be submitted by email 14 days in advance of the final billing date. Any cancellation request that falls inside of the last 14 days of the billing period will result in additional charges for the following pay period. Pausing a Google Ads campaign does not result in the cancellation of the Google Ads Management Service Delivered by Lead Farmers PPC. Service delivery will continue uninterrupted until a cancellation request is submitted.
Refunds
Lead Farmers PPC does not provide refunds for the Service delivered through the user’s Google Ads account. Services are delivered as-is and are not subject to full or partial refunds. Lead Farmers PPC is not responsible for refunding or reimbursing user for accrued ad spend through the Google Ads platform.
Privacy
Under no circumstances does Lead Farmers PPC use any information provided by the user for marketing, distribution, or third part sales. All information is kept strictly confidential from the start date of the Service throughout the lifetime of the account.
